西班牙在16世纪中期对菲律宾群岛的占领,标志着菲律宾法的历史开始了一个新纪元,不同于当地人的法律和习惯的外来法律制度——西班牙法被引入群岛。此后,菲律宾法不断在外来法的影响下成长,今天的菲律宾法是受到多种外来因素深刻影响的结果。~①但在西班牙人到来前,在菲律宾群岛生活的人们已经有了自己的习惯或法律。这些前西班牙时期的习惯和法律对西班牙人占领后的菲律宾法的发展也有一定的影响。由于群岛中部、北部与南部社会发展水平与法律发展水平的差异,以及西班牙人对这些地区征服程度的不同,导致了西班牙统治时期群岛不同地区原有习惯与法律迥异的生存状态。
The Spanish occupation of the Philippine archipelago in the mid-16th century marks a beginning of a new era in the history of Filipiname law. It is different from the laws and customs of locals in that it is an external legal system - Spanish law was introduced into the archipelago. Since then, Filipino law has constantly grown under the influence of foreign law, and today’s Filipino law is the result of a profound influence on various externalities. However, before the arrival of the Spaniards, people living in the Philippine Islands already had their own habits or laws. These pre-Hispanic customs and laws also had an influence on the development of the Philippine law after the Spanish occupation. Due to the difference between the level of social development and the level of legal development in the central, northern and southern islands, and the degree of conquest by the Spaniards in these areas, the existing habits and laws in different areas of the archipelago during the Spanish rule were different.
