笔者认为,在法律文化研究语境中的“非洲”一词应该指的是整个非洲大陆,而不能单指“黑非洲”。首先应关注的是非洲作为一个独特法域的整体性,然后才是它的多样性。这种多样性又可以细分:大的方面可分为北非地区的阿拉伯一伊斯兰法律文化区和撒哈拉以南的黑人法律文化区;小的方面可分为若干国家或民族的法律文化。总之,要将整体性和多样性结合起来研究。其理由如下:
In the author’s opinion, the term “Africa” in the context of legal culture research should refer to the entire African continent, not to “Black Africa” alone. The first thing to look at is the unity of Africa as a distinct legal jurisdiction, and then its diversity. This diversity can be further subdivided: the larger aspects can be divided into the Arab-Islamic Cultural District of North Africa and the Negro Legal Cultural District of Sub-Saharan Africa; the smaller aspects can be divided into legal cultures of several countries or nations. In short, we must study the unity and diversity together. The reasons are as follows:
