教师对学生的惩罚自古便有,即便在当今的美国、韩国、澳大利亚等国也都在延续着,甚至对教师惩戒的方式都做出了详细的规定。但是在我国,法律上却未对教师惩戒权的属性作出明确的说明,以至于我们在教育教学管理中出现了误区。分析权力的含义,可以让我们理解教师惩戒权的权力属性;了解权利的含义,可以让我们理解教师惩戒权的权利属性。通过对教师惩戒权的权力属性和权利属性的比较分析,我们发现教师惩戒权不仅是教师的一种权力,同时也是一种权利,其具有双重的复合属性。
Teachers punish students since ancient times, even in today’s United States, South Korea, Australia and other countries are also continuing, and even disciplinary methods teachers have made detailed provisions. However, in our country, the law does not give a clear description of the nature of the disciplinary power of teachers, so that we have misunderstood in the education and teaching management. Analysis of the meaning of power allows us to understand the power attributes of teachers ’disciplinary rights. To understand the meaning of rights allows us to understand the right attributes of teachers’ disciplinary rights. Through the comparative analysis of the power attribute and the right attribute of the disciplinary power of teachers, we find that the power of teachers’ discipline is not only a kind of power but also a kind of right of teachers, which has the dual complex nature.
