规制是指政府为控制企业的价格销售和生产决策而采取的各种行动,并公开宣布这些行动是要制止不充分重视社会利益的私人决策。美国1890年制定的《谢尔曼法》被称为“世界各国反垄断法之母”。改革开放后我国引入了竞争机制,国家也陆续颁布了若干法规。2008年8月1日颁布施行的《反垄断法>,明确了需要规制的垄断行为,这标志着我国社会主义市场经济法律体系、尤其是经济法体系逐渐完善,自此我国的反垄断实践工作终于旗帜鲜明地由幕后转到了台前。
