设立抵押权的目的在于以抵押物的价值担保主债权的履行,在主债权不能得到保护时,债权人可以通过优先受偿方式实现抵押权,并最终实现债权。对抵押权的实现,2007年10月1日施行的《物权法》第195条在《担保法》的基础上作出了具体规定,如果债务人不履行到期债务或发生当事人约定的实现抵押权的情形,抵押权人可以与抵押人协议以抵押财产折价或者以拍卖、变卖该抵押财产所得的价款优先受偿。如果双方没有就抵押权实现方式达成协议,则抵押权人可以直接请求人民法院拍卖、变卖抵押财产。
