能动司法是我国法官审理案件时的本能反应,并不具有美国司法能动主义的理论基础和实践内容。不能在没有厘清司法能动主义概念的前提下就借用该词的外衣来探讨我国的司法实践。在对司法能动主义认识不统一,缺乏正当理论支撑时,出现了带有实用主义色彩的理解。必须对“摸着石头过河”的“能动司法”进行认真反思。本文从能动司法的表现、对司法能动主义的研究、意义和对能动司法的反思三方面,对我国司法中萌动的能动司法做了研讨。
Active judicature is the instinctive reaction of our judges in hearing cases and does not have the theoretical basis and practical content of American judicial activism. We can not borrow the word coat without discussing the concept of judicial activism to explore our judicial practice. In the absence of a unified understanding of judicial activism and a lack of justification, a sense of pragmatism emerged. We must seriously reflect on the “active justice” of “feeling the stones across the river.” This essay discusses the motivated justice in China from three aspects: the performance of active justice, the research on judicial activism, the significance and the reflection on active judicial.
