《劳动合同法》八十二条规定用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的,应当向劳动者每月支付二倍的工资;但未对二倍工资计算基数的规定,导致在司法实务中,不同法院依据不同的规定对二倍工资计算基数做出了不同的判决,理论界也有不同的观点。本文结合实际案例以及相关法规对未签订书面劳动合同双倍工资计算基数的适用问题进行探讨。总结具有典型意义的实务经验和法律意见。
