反垄断法能否有效地得到实施,即国家能否有效地保护竞争和抑制垄断,在很大程度上取决于能否建立一个反垄断法的责任制度对反垄断行为进行有效地制裁。①反垄断法法律责任是指由于非法垄断主体实施的行为违反了反垄断法之法定义务、超越反垄断法之法定权利界限或滥用权利而必须承担的具有强制性、否定性的法律后果。但由于我国的反垄断法立法以及司法实践都起步不久,目前最重要的是要建立完善可行的民事责任制度。本文欲对立法中非法垄断之民事责任规定进行梳理。
Whether the antitrust law can be effectively implemented, that is, whether the state can effectively protect competition and curb monopoly depends to a large extent on the possibility of establishing an accountability system for antitrust law to effectively sanction antitrust acts. ① The legal liability of antitrust law refers to the mandatory and negative legal consequences that must be borne by parties that violate the statutory obligations of antitrust law, go beyond the limits of the legal rights of antitrust laws or abuse their rights. However, due to the fact that our country’s antitrust law legislation and judicial practice have not started yet, what is most important now is to establish a sound and feasible civil liability system. This article attempts to sort out the civil liability provisions of the illegal monopoly in the legislation.
