"上海钓鱼执法"一案,在网络和民意的监督下,一时把上海执法部门推到风口浪尖之上,让其有点不知所措.笔者并不想过分指责上海相关执法部门,而是试图从制度和文化的视角分析现象背后的根源.笔者认为上海执法部门的违法行为折射出当下国民法律信仰的严重缺失,以"上海钓鱼执法"案为素材,首先,阐述法律信仰的确切含义和本质;其次,根据目前我国法律信仰缺失的状况着重探讨原因所在;最后,基于实践考察和理论研究,提出生成法律信仰的几点思考.
