金融创新的升级,促使“金融消费者保护”这一问题日益受到重视。当前我国金融消费者所处境遇堪忧,主要表现在角色定位尴尬、被侵权形式多样化、维权进程步履维艰等方面。将金融消费者保护纳入金融监管范畴,不仅符合市场化监管理念的要求,而且顺应了我国推进金融创新的社会潮流。从金融监管视角探析金融消费者保护,旨在实现行政监管、自律监管和社会监管的有机统合,兼顾其中存在的特殊问题,探寻金融消费者保护的可行性路径。
The upgrading of financial innovation has prompted the issue of “financial consumer protection” to be paid more and more attention. At present, the situation of financial consumers in our country is in a dilemma, which is mainly manifested in embarrassment of role orientation, diversification of forms of infringement and difficulties in safeguarding rights. The inclusion of financial consumer protection in the area of financial regulation not only meets the requirements of market-oriented regulatory concepts, but also complies with the social trend of promoting financial innovation in our country. From the perspective of financial supervision, the paper analyzes the protection of financial consumers in order to realize the organic combination of administrative supervision, self-regulation and social regulation, take into account the special problems therein and explore the feasibility of financial consumer protection.
