一个国家怎样解决海洋污染损害、航行安全及旅客人身伤亡赔偿问题,在很大程度上取决于该国面临的实际问题及其对海洋环境保护及人身利益问题的重视程度。我国目前除了1992CLC之外,还没有加入其他的海上强制责任保险公约。我国海上运输的实践表明,我国海上运输领域亟待引入强制保险。作为解决责任人保证赔偿责任能力、分散经营风险和保护受害人利益的机制,海上强制保险的建立具有紧迫性和积极性,有必要尽快完善我国的海上强制责任保险制度。
How a country resolves the issue of marine pollution damage, navigation safety and passenger personal injury compensation depends to a large extent on the practical problems facing the country and its emphasis on marine environmental protection and personal interests. At present, except for the 1992CLC in our country, we have not joined other conventions on maritime compulsory liability insurance. The practice of maritime transport in our country shows that urgent compulsory insurance should be introduced in the field of maritime transport in our country. As a mechanism to solve the responsibility of the liable persons to guarantee the liabilities of compensation, spread the business risks and protect the interests of the victims, the establishment of maritime compulsory insurance has the urgency and enthusiasm. It is necessary to perfect our maritime compulsory liability insurance system as soon as possible.
