司法责任制改革背景下,检察官承担的司法责任日益严格,民众对司法权行使的关注度更是日益高涨,而检委会作为重大案件的决策者,发生错案所承担的集体责任,因规定不明确、追责机制缺位等原因却等同于无责,与司法责任制的基本原则明显相悖。本文通过探讨检委会责任应注意和解决的问题入手,试探索检委会司法责任追究机制的路径构建。 Under the background of reforming the judicial responsibility system, the judicial responsibility assumed by the prosecutor is increasingly strict. The people’s attention to the exercising of the judicial power is even more and more rising day by day. However, as the decision-maker of the major cases, the ICC takes the collective responsibility for the wrong case. The reasons such as the lack of clarity and absence of the accountability mechanism are equivalent to no responsibility and are obviously contrary to the basic principles of the judicial responsibility system. This paper starts with exploring the issues that should be paid attention to and resolving the responsibility of the CIW Commission and tries to construct the path of investigating the mechanism of judicial responsibility of CIWC.
