目前学界对公私协力的研究多从公私协力行为的角度进行讨论,鲜有从公私协力主体的角度进行分析,这种状况无助于公私协力研究的深入开展。作为一个整合性概念,公私协力主体系指参与公私合作关系的公、私部门主体以及因合作产生的派生主体,具有主体构成的多样性、主体角色的复合性、主体目标的合作性等法律特征。它可以划分为原生型主体与次生型主体两大类,前者包括公共部门、私人部门、公法上的消费者,后者涵盖公权力受托人、特许经营者、政府业务承包人、社会合作管制主体以及公私合作公司。公私协力主体的兴起,对于我国行政组织法构成了挑战,是一个有待深入研讨的新型课题。
At present, the study of public-private partnerships in academic circles mostly discusses from the perspective of public-private partnerships and seldom analyzes from the perspective of public-private partnerships, which is not conducive to the further development of public-private partnerships. As an integrated concept, the public-private partnership refers to the legal features of the public-private-sector main bodies involved in public-private partnerships as well as their derived counterparts due to cooperation. They include the diversity of the main body, the compounding of the main role and the cooperation of the main object . It can be divided into primary and secondary main body of two categories, the former includes the public sector, the private sector, public law consumers, the latter covers the public power trustees, franchisees, government contractors, social cooperation control The main body and public-private partnerships. The rise of the main body of public-private cooperation constitutes a challenge to the administrative organization law of our country and is a new topic to be further discussed.
