因职务犯罪具有的隐蔽性强、案外因素多、干扰强等特点使得职务犯罪侦查活动具有其他犯罪侦查活动所不具有特殊复杂性。在职务犯罪侦查活动中,干扰办案的案内案外因素多,使得正确适用强制措施成为影响办案成效的重要因素。笔者首先对职务犯罪侦查活动适用强制措施时由于现有的强制措施体系缺乏层次性,强制措施之间缺乏过渡和衔接导致的种种问题进行了分析。进而结合刑诉法的修改分析职务犯罪侦查中适用强制措施的层次性体系,并对落实新刑诉法规定,完善职务犯罪侦查中强制措施适用体系,转变职务犯罪侦查思路提出自己的见解。

At first, the author analyzes the problems caused by the lack of hierarchy of the existing compulsory measure system and the lack of transition and cohesion between the compulsory measures when applying the compulsory measures. Then it analyzes the hierarchy system of applying compulsory measures in the investigation of job-related crimes in combination with the revision of the Criminal Procedure Law, and puts forward my own opinions on the implementation of the new Criminal Procedure Law, perfecting the applicable system of compulsory measures in the investigation of job-related crimes and changing the investigation of job-related crimes.
