香港特别行政区法院在行使司法审查权时,尤其是审查涉及人权保障立法的场合,常常秉持司法能动主义。这不仅使香港特别行政区法院很可能演变为政治纠纷的裁决者,而且客观上也可能改变《香港特别行政区基本法》既定的权力结构。尽管香港特别行政区法院是否享有司法审查权及其司法审查权的正当性一直存在质疑,但司法审查的实践已经客观存在。立足于这个事实,本文提出香港特别行政区法院可以在对话理论的基础上行使司法审查权,以达成克制香港特别行政区法院过激的司法能动之目的,使司法审查权成为配合香港特别行政区立法会和香港特别行政区政府解决问题的一种制度方法。
The courts of the Hong Kong Special Administrative Region often uphold judicial activism in the exercise of judicial review powers, especially in examining the legislation concerning the protection of human rights. This not only makes it possible for the courts of the Hong Kong Special Administrative Region to evolve into arbitrators in political disputes, but objectively it is also possible to change the established power structure of the “Basic Law of the Hong Kong Special Administrative Region.” Although the courts of Hong Kong Special Administrative Region have always been questioned whether they enjoy the power of judicial review and the right of judicial review, the practice of judicial review has existed objectively. Based on this fact, this paper proposes that courts of Hong Kong SAR may exercise the power of judicial review on the basis of dialogue theory so as to achieve the purpose of restraining the excessive judicial power of the courts in Hong Kong Special Administrative Region and to make the judicial review right cooperate with the Legislative Council of Hong Kong Special Administrative Region and Hong Kong Special Administrative Region Government to solve the problem of a system approach.
