2012年3月14日全国人大审议通过的新《刑诉法》第一次以法律的形式确立了未成年人附条件不起诉制度,并成为此次《刑诉法》修改的一大亮点。但是将未成年人附条件不起诉正式纳入法律行列,扩大了检察机关的不起诉裁量权,由此可能引发起诉裁量权滥用的风险,有必要引入外部的力量监督进行,才能保证检察权不被滥用。本文试从附条件不起诉制度的立法背景、引入人民监督员制度的构想、实践操作等方面,探索将人民监督员制度引入附条件不起诉案件的整个办理过程,从而能更好地推动人民监督员制度的自我完善。
On March 14, 2012, the new Criminal Procedure Law passed by the National People’s Congress established, for the first time, the non-prosecution of juvenile conditional non-prosecution system in the form of law and became a major bright spot in the revision of the Criminal Procedure Law. However, the non-prosecution of minors with conditions is formally incorporated into the law, expanding the prosecutorial non-prosecution discretion, which may lead to the risk of abuse of prosecutorial discretion, it is necessary to introduce external supervision of power in order to ensure that prosecutorial power is not abuse. This article attempts to explore the whole process of introducing the people’s supervisor system into the conditional non-prosecution cases from the legislative background of conditional non-prosecution system and the introduction of the concept and practice of the people’s supervisor system so as to better promote the people’s supervision Staff system self-improvement.
