通报执行裁决的意向是WTO裁决执行程序中的第一个环节。按照WTO的规定,有关成员必须在争端解决机构通过裁决的30天内通报其执行裁决的意向。该项义务在法律上检验了成员执行WTO裁决的立场和态度,在程序上则承上启下,实现从诉讼裁决阶段向裁决执行阶段的转换,启动整个裁决执行机制。实践表明,成员在通报裁决意向问题上的态度十分关键,不仅为所有其他成员所关注,对执行方自身也包含着一定的政治影响和法律后果。
The notification of the intention to implement the ruling is the first step in the WTO ruling process. According to WTO rules, relevant members must notify their intention to enforce the award within 30 days after the dispute settlement body passed the ruling. This obligation legally verifies the position and attitude of members in implementing the WTO ruling. It is procedurally procedural and enables the transition from the stage of procedural award to the stage of execution of the ruling and the implementation of the entire ruling mechanism. Practice shows that members’ attitudes toward notifying the intention of the award are crucial not only for all other members but also for the executive itself.
