董仲舒首次运用的“以《诗》决狱”是对其“以《诗》为法”《诗》学观的落实,而其“以《诗》为法”的《诗》学观则是在其《春秋》学基础上提出来的。在董仲舒的影响下,“以《诗》决狱”被汉代学者反复使用,从而成为汉代极具特色的用《诗》方式之一。但学界对“以《诗》决狱”并未给予应有的重视。目前所能见到的相关成果,只有刘立志的《汉人引诗决狱刍议》①一文,该文主要从秦汉时期儒法合流的角度对此进行了探讨,而对于董仲舒之“以《诗》决狱”观生成的内在经学
