劳动合同作为职工和用人单位之间劳动关系的重要凭证,在实际签订中往往被一些职工乃至用人单位忽视。在劳动关系不明确的情况下,职工和单位之间如果没有矛盾或纠纷,双方自然相安无事,可一旦出现工伤事故,劳动合同的签订与否则成为职工在维权过程中一柄双刃剑。2012年4月,西安市高陵县的贺某在高陵县马家湾某项目部进行铲土工作,不慎从筛土机上坠落致伤。事故发生后,同行工友将其送往长庆石油职工医院治疗,经检查医院建议应立即转往西安市红十字
