随着我国人民生活水平的提高,法律意识的增强以及医疗行业高风险性的存在,医疗纠纷的发生呈不断增加趋势,医患关系日趋紧张。以北京市海淀区人民法院受理医疗纠纷案为例足以见之,1999年该院受理医疗纠纷案件9件,2000年受理案件13件,2001年共受理22件,2002年受理55件。中华医院管理学会2002年对全国326所医院进行调查显示医疗纠纷发生率高达98.4%,索赔金额总计约6000万元左右。如此之多的医患纠纷,作为政府“管”医院的代理人——卫生行政部门在处理医疗纠纷中具体承担哪些职责?如何正确行使自己的权利?如何使医疗纠纷得到合法、公正、公平、及时的处理?将是摆在卫生行政部门面前的一个重要问题。
With the improvement of people’s living standards in our country, the enhancement of legal awareness and the high risk of the medical industry, the incidence of medical disputes has been on an upward trend and the relationship between doctors and patients has become increasingly tense. Take Beijing Haidian District People’s Court for medical malpractice as an example. In 1999, the hospital handled 9 medical disputes and handled 13 cases in 2000, 22 in 2001 and 55 in 2002.
