在国际海运中,根据方便旗船涉及到的几个不同角色之间的关系,形成了几种不同的方便旗船运营模式,这给海事请求权人提起扣押方便旗船的申请带来了一定困难。基于剖析几种不同的方便旗船经营模式,分析海事请求人提出扣船申请的具体指向,并依据我国《海事诉讼特别程序法》第23条规定的扣船范围分析是否可得到扣押方便旗船的理论支持,从而充分、有效地保障海事请求权人的合法权益。
In international seaborne, several different modes of convenience flag ship operations have been developed, based on the relationship between several different roles involved in the convenience of flag ships, which have brought certainty to the request of the maritime claimant to file a seizure-friendly flag ship difficult. Based on the analysis of several different business modes of convenience flagship ship, this paper analyzes the specific directions of maritime claimant in applying for arresting ship and analyzes whether the seizure-friendly flag ship can be obtained according to the scope of the arrest of the ship as stipulated in Article 23 of China’s Special Procedures for Maritime Litigation Theoretical support, so as to fully and effectively protect the legitimate rights and interests of maritime claims.
