版权和媒体以及言论自由在网络时代呈现出复杂关系:一方面,版权对言论自由的推动在网络时代不再如“引擎”般重要;另一方面,版权仍然被用来阻止独立言说者进入市场,限制言论自由。纵横交错的版权产业结构是这种限制的深层原因,传统反垄断法的强制许可在限制版权方面阻力重重。而网络技术带来的新的商业模式如iTunes和YouTube使得版权对言论自由的限制得到一定程度的减缓。信息分享或许可以成为版权发展的新方向。
