著作权延伸性集体管理制度已成功地在北欧地区运行了超过50年并取得了巨大的社会成效。在中国著作权法的第三次修改工作中,立法者尝试将该制度引入我国的著作权法体系中,并在三次公布的草案中对该制度进行了调整。然而,延伸性集体管理制度的可行性引发了巨大的争议,这些争议主要集中于集体管理组织的代表性、对于非会员权利人的保护以及纠纷解决机制方面。本文作者认为延伸性集体管理制度在实践中能够很好地解决著作权授权问题,然而立法者在移植该制度时仍应当对于几个方面的问题加以重视。
The extension of copyright collective management system has been successfully run in the Nordic region for more than 50 years and has achieved great social results. In the third revision of copyright law in China, legislators tried to introduce the system into the copyright law system of our country and adjusted the system in the three drafts. However, the feasibility of an extended collective management system has sparked a great deal of controversy, with the main focus of controversy on the representation of CMOs, on the protection of non-member obligee and on dispute resolution mechanisms. The author of the paper thinks that the extension of collective management system can solve the problem of copyright authorization in practice. However, legislators should pay attention to several aspects when transplanting the system.
