法律制度可以通过对投资者权利保护来影响金融市场发展。法系渊源对金融发展的因果关系自从被提出之后就获得了广泛的关注和质疑。国际金融中心的形成和发展已被归纳出诸多要素,其中包括完备的法律制度。法系渊源究竟是否是金融发展的关键因素,对国际金融中心的法律制度建设极为重要。文章分析了“法律与金融”理论对投资者权利保护量化指标体系的设定和修正,继而对法系渊源的影响路径展开探讨,并比较文化历史渊源与法系渊源的作用,最后通过新制度经济学的分析框架,考量交易成本和法系渊源孰能更客观地反映一国的金融发展选择。在此基础之上提出国际金融中心形成和发展的相应建议。 The legal system can affect the development of financial markets through the protection of investors’ rights. The causal relationship between legal system origin and financial development has gained wide attention and question since it was proposed. The formation and development of international financial centers have been summed up with many elements, including a complete legal system. Whether the origin of legal system is the key factor of financial development is very important to the construction of the legal system of international financial center. The article analyzes the establishment and revision of the quantified index system of investor rights by the theory of “law and finance”, then explores the influence path of the legal system origin, compares the historical origin of culture and the origin of legal system, and finally passes The new institutional economics analysis framework, considering the transaction costs and the origin of the legal system more objectively reflect the financial development options of a country. On this basis, I put forward corresponding suggestions on the formation and development of international financial centers.
