争端双方为解决工程争端所进行的一系列选择统称为“工程争端决策”。通过文献研读和专家访谈,总结归纳出影响工程争端决策的25个因素。邀请来自我国工程建设行业的200多位专家和从业人员对各因素的重要程度进行打分,采用因子分析,去除相关性后,将所有因素归为八个公共因子:证据力度、争端处理人员、司法环境公平度、损益值、先例、合同绩效、企业项目文化和保密性,并据此建立我国工程争端处理决策过程模型,期望能对我国建设业的从业者有所借鉴。
A series of choices made by both parties to the dispute to resolve the project dispute are collectively referred to as “project dispute decision-making.” Through literature review and expert interviews, it is concluded that there are 25 factors affecting decision-making on engineering disputes. Invited more than 200 experts and practitioners from the engineering construction industry of our country to rate the importance of each factor. After removing the correlation by using factor analysis, all factors were classified into eight public factors: the intensity of evidence, the personnel handling disputes, the judiciary Environmental fairness, profit and loss value, precedent, contract performance, corporate project culture and confidentiality. Based on this, the model of process decision-making in engineering dispute settlement in our country is established.
