美国是最早建立缺陷产品召回制度的国家,其他发达国家也有近半个世纪的发展历史。大多数发达国家都已经形成了比较完整、相对成熟的产品召回法律体系。本文通过比较研究的方式,对中、美缺陷产品召回制度进行比较研究,并从立法体系、监督分工、惩罚机制、召回模式四个角度进行比较,并形成建议。 The United States was the earliest country to establish a recall system for defective products. Other developed countries also have a nearly half-century history of development. Most developed countries have formed a relatively complete and relatively mature product recall law system. In this paper, a comparative study of the defective product recall system in China and the United States comparative study, and from the legislative system, oversight of the division of labor, punishment mechanism, the recall model from four angles to make recommendations.
