司法改革必须以内外部环境的存在作为改革前提方能取得成功。本文对司法改革与司法环境的相互作用进行了分析,认为司法环境制约着司法改革的形式和内容,而适当的司法改革能够推动司法环境的改善。本文在分析当前各学者所提的各种宏观的司法改革路径的基础之上提出了司法聚合主义的改革路径,即司法改革要取得成功必须要结合改革的环境和条件。 Judicial reform must be successful only if the internal and external environment exist as a prerequisite for reform. This article analyzes the interaction between judicial reform and judicial environment, and holds that judicial environment restricts the form and content of judicial reform, and appropriate judicial reform can promote the improvement of judicial environment. Based on the analysis of various macroscopic judicial reform paths mentioned by current scholars, this paper puts forward the reform path of judicial polymerizationism. That is to say, in order to be successful, judicial reform must combine with the environment and conditions of reform.
