近年来,移植器官和人工假体的使用越来越广泛。一些移植器官和人工假体不同程度地替代原有器官的作用和功能,因此,将移植器官和人工假体视为身体的一部分并给予法律保护具有重要的现实意义。目前的伤残等级鉴定标准中,伤残评定标准均围绕自然身体的原发性损伤、并发症及后遗症进行规定,缺乏移植器官和人工假体损害方面的规定。遵循鉴定标准之间的关联性以及基本鉴定准则的一致性,本文参照最新损伤程度鉴定标准中关于移植物和人工假体的规定,对移植器官和人工假体损害后如何进行伤残评定进行了研究和探讨。本文所提出的移植器官和人工假体损害伤残程度评定建议对于伤残评定实践工作有一定的借鉴意义。
