行政决定作出过程中往往涉及当事人的协力,学界目前的看法是将之视为协力义务。2005年在我国台湾地区召开的“两岸行政法学术研讨会”上,有关与会学者对此经过讨论后,较为一致的看法是认为行政程序中的当事人协力既是一种义务也是一种权利,因而具有相对性。行政协力义务相对性表现在:它不是一种绝对义务,其义务设置应该有所限定。正确认识当事人程序权利义务的相互关系,有助于行政立法的更加完善。
The executive decision-making process often involves the parties involved, the current view of the academic community is to view it as a synergistic obligation. After the participants discussed this issue in 2005, “Taiwan Academic Seminar on Administrative Law” was held in Taiwan of China. A more consistent view is that the parties involved in the administrative proceedings are both an obligation and a right, So relativistic. The relative nature of the obligation of administrative cooperation is that it is not an absolute obligation and its obligation should be limited. Correctly understanding the interrelationship between the parties’ procedural rights and obligations helps to improve the administrative legislation.
