行政公益诉讼作为客观诉讼的一种,需要厘清其自身价值定位,规范司法实践路径,创造理论和实践的双向互动机制.安徽省作为试点省份,在行政公益诉讼制度方面进行了有益的探索,但通过归纳安徽省行政公益诉讼案件可知,该类案件中仍存在着“诉讼请求不完善、诉讼主体不多元、诉讼范围不明确、诉讼程序不科学”等问题.为此,通过“增加损害赔偿的诉讼请求完善诉求机制;吸纳公民、社会组织作为诉讼原告拓宽诉讼主体;明确公务员奖金福利发放等领域作为行政公益诉讼范围;完善诉前保全制度规范行政公益诉讼程序”等措施,能够有效地破解我国行政公益诉讼中的困局.
