21世纪初期,阿根廷经济危机和南美国家实施的一系列国有化政策引发了欧美投资者对其在解决投资争端国际中心(IC-SID)的诉讼。由此,拉美国家开始重新审视ICSID,他们指责ICSID与世界银行有关联,在裁决中没有给予诸如健康和环境保护等非商业性利益以足够关注。由于ICSID仲裁缺乏透明度、没有上诉程序,而仅仅设置有限的撤销程序,使其合法性遭到拉美国家的质疑。
In the early 21st century, the economic crisis in Argentina and a series of nationalization policies implemented by South American countries triggered the lawsuits of European and American investors over the International Center for Settlement of Investment Disputes (IC-SID). As a result, Latin American countries began to re-examine ICSIDs, accusing ICSID of being associated with the World Bank and failing to pay sufficient attention to non-commercial interests such as health and environmental protection in their rulings. Due to the lack of transparency in ICSID arbitration and the absence of appeal procedure, only a limited procedure of revocation has been put in place to make its legitimacy challenged by Latin American countries.
