大数据时代下消费者隐私问题备受关注,但一直以来经济学家对消费者隐私保护的作用存在较大争议。论文对隐私保护福利效应的争论进行了梳理,进而详细讨论了企业和消费者分别在隐私保护和数据披露下的成本收益,并进行了隐私保护监管边界的经济性分析,最后对中国消费者隐私保护的监管政策进行思考。论文指出,现阶段消费者隐私保护的监管政策应强调健全消费者隐私保护法律政策体系,营造政府监管与市场自律互补融合的格局,合理界定隐私保护的范围,积极开发隐私保护技术能力,科学审核隐私侵权成本,加强消费者隐私保护教育,以提高消费者隐私保护的监管效率。
The issue of consumer privacy in the era of big data has drawn much attention, but economists have long been controversial over the role of consumer privacy. The dissertation combs the controversy over the welfare effects of privacy protection, and then discusses in detail the cost-benefit of enterprises and consumers under the protection of privacy and data disclosure and the economic analysis of the regulatory boundaries of privacy protection. Finally, the author analyzes the privacy of Chinese consumers Protection of the regulatory policy to think. The paper points out that at this stage, the regulatory policies on consumer privacy protection should emphasize the improvement of the legal and policy system of consumer privacy protection, the pattern of complementary government regulation and market self-regulation, the reasonable definition of the scope of privacy protection, the active development of privacy protection technology capabilities, Privacy costs of infringement, strengthen consumer privacy education, in order to enhance the efficiency of consumer privacy protection supervision.
