实体音乐在音乐行业占据主导地位的时代已然成为过去,取而代之的是数字音乐形式的蓬勃发展。数字音乐以其传播范围广、速度快且音质无损耗的特点,一方面使更多“音乐发烧友”得益,另一方面也为著作权人的利益保护带来了风险。从本次《著作权法》的修订可以看出我国加大了对数字音乐著作权保护的力度。本文将结合送审稿的相关规定,同时借鉴日本的相关立法,力求为我国数字音乐著作权的保护提供更多可行性思路。
The era in which physical music dominates the music industry is a thing of the past, replacing the thriving digital music scene. Because of its wide spread, fast speed and no loss of sound quality, digital music benefits more musicians and, on the other hand, brings risks to the interests of copyright owners. It can be seen from the revision of this Copyright Law that China has stepped up the protection of digital music copyright. This article will be combined with the relevant provisions of the draft for review, at the same time drawing on the relevant Japanese legislation, and strive to provide more feasible ideas for the protection of digital music copyright in our country.
