共有物分割包括协议分割与裁判分割两种途径。法院在对共有物进行裁判分割时,首先应采取原物分割的方法,并可以结合案件具体情况采取法定方法以外的其他分割方法。法院对共有物的分割方法享有自由裁量权,不受当事人诉讼请求的限制。共有物经裁判分割后,自判决生效时发生所有权移转的效力,共有人之间对分得的共有物承担瑕疵担保责任。
The common object segmentation includes the agreement segmentation and the referee segmentation two ways. When the court conducts refereeing of the common property, the court should first adopt the method of original partition, and may adopt other methods besides the statutory methods in combination with the specific circumstances of the case. The court has the discretion to divide the method of the communal property and is not subject to the request of the litigant. After the commonweal is divided by the referee, the effect of the transfer of ownership occurs at the time of the judgment coming into force, and the joint owners shall assume the responsibility of guaranteeing the defects for the share acquired.
