关于犯罪客体问题,理论界分歧较大,有许多不同观点。就其合理性而言,法益说比较妥当,马克思指出,把市民社会的成员彼此连结起来东西是什么?是利益。法律最终目的,不过是整个社会的最大利益而己。犯罪行为侵犯的就是利益,犯罪客体为利益。但法律作为一种规范体系的存在,犯罪客体不能脱离法律形式。 There are many different opinions on the object of crime in theorists as there is great divergence in theorists. As far as its rationality is concerned, the law and interests are more appropriate. Marx pointed out that it is an interest to link members of civil society to one another. The ultimate goal of law is nothing more than the best interests of society as a whole. Crime is the violation of interests, the object of crime for the benefit. However, as a legal system, the existence of law, the object of crime can not be divorced from the legal form.
