本文从一起养殖场对外提供自行配制饲料案入手,介绍了案件来源、调查取证过程、处理情况等执法过程。针对办案过程中遇到的实际问题,提出了准确认定违法行为、严格执行案件集体讨论制度、行政处罚自由裁量权制度、保障当事人陈述申辩权、及时纠正和完善案件处理过程中的疏漏等建议。 This article starts with a farm to provide self-formulated feed to start with, introduced the source of the case, the process of investigation and evidence collection, handling and other law enforcement process. In view of the practical problems encountered in the handling of cases, the paper put forward some suggestions such as accurately identifying the illegal activities, strictly enforcing the system of collective discussion on cases and the discretionary power of administrative punishment, safeguarding the parties’ right of defense and timely rectifying and improving the case handling.
