经济性裁员制度是工人单位吐故纳新、提高经济效益的有效手段,却也是劳动者的梦魇,同时还影响劳动力市场与经济社会的稳定。本文在比较法的语境下通过对欧盟、法国等发达国家或地区的相关立法的规范考察,反思我国经济性裁员制度的立法缺陷,并尝试探讨相关制度的完善。
Economic system of layoffs is an effective means for employers to make new decisions and improve economic efficiency. However, it is also a nightmare for laborers. It also affects the labor market and economic and social stability. In the context of comparative law, through the normative investigation of the relevant legislation in developed countries and regions such as the EU and France, this article reflects on the legislative defects of the economic layoff system in our country and attempts to explore the perfection of the relevant system.
