森林碳汇在应对全球气候变化方面具有独特的优势。我国《森林法》中原有的植树造林制度、封山育林制度、退耕还林制度、森林分类经营制度、森林采伐制度、森林生态效益补偿制度、森林碳汇交易制度对扩大我国的森林面积,增加森林碳汇发挥了一定的作用,但其都不是以保护生态环境,增加森林碳汇,应对气候变化为出发点,故而使得我国当前的《森林法》对通过森林增汇应对气候变化的相关法律制度还存在着诸多的不足及缺陷,应通过《森林法》的修改,完善我国各项森林增汇法律制度,充分发挥《森林法》在保护环境,应对气候变化方面的重要作用。
Forest carbon sinks have unique advantages in addressing global climate change. The original forestation and afforestation system, the system of returning farmland to forests, the management system of forest classification, the system of forest harvesting, the compensation system of forest ecological benefits and the system of trading of forest carbon in our country’s Forest Law have the important function of expanding forest area and increasing forest carbon However, they all do not start from the point of protecting the ecological environment, increasing forest carbon sinks and coping with climate change. Therefore, the current “Forest Law” of our country still has some legal systems to deal with climate change through increasing forest sinks With many deficiencies and deficiencies, the “Forest Law” should be amended to improve the legal system of various forest remittances in our country and give full play to the important role of “Forest Law” in protecting the environment and coping with climate change.
