随着我国社会经济的发展和住房市场化改革的继续深入,商品房预售形式已成为房地产市场主要的买卖方式之一。但是商品房预售比现房交易具有更大的风险,因此需要建立相应的风险防范机制对之进行防控。针对于此,本文指出了商品房预售预告登记制度的必要性。同时,本文分析了预告登记的性质和效力,并将商品房预售合同备案登记制度和预告登记制度进行了比较,指出了预售合同备案登记制度对预购人利益保护的不足,从而提出应当构建完善的商品房预售预告登记制度的建议。
With the development of China’s social economy and housing market reform continue to deepen, the pre-sale of commercial housing has become the real estate market, one of the main ways of buying and selling.
