“不可抗力”是一个法律术语,按照我国《民法通则》和《合同法》等法律的定义,不可抗力是指不能预见、不能避免并不能克服的客观情况。它包括自然现象和社会现象两种,自然现象诸如地震、台风、洪水、海啸;社会现象如战争、海盗、罢工、政府行为等。《民法通则》第107条中规定,因不可抗力不能履行合同或者造成他人损害的,不承担民事责任。《合同法》第117条中规定,因不可
“Force Majeure ” is a legal term. According to the definitions of “General Principles of Civil Law” and “Contract Law” in China, force majeure refers to the unforeseeable and unavoidable objective conditions that can not be overcome. It includes two kinds of natural phenomena and social phenomena.
