涉及美国威斯康辛州集体谈判权的预算修正法案的核心内容是限制公共部门工会在工资、养老和医疗等方面进行集体谈判的范围。工会在反对这一法案的博弈中之所以失败,主要是因为原来的通过集体谈判决定的公共部门雇员的工资保险福利水平,与其他部门相比的确出现了失衡。从威斯康辛州的立法博弈中能够得出三点启示:公共部门工资福利水平的确定应恪守平衡原则;我国公共部门员工工资福利水平的确定短期内不应推行集体谈判;“依法规范和决定”是确定我国公共部门员工工资福利标准、减少社会争议的最有效途径。
Central to the budget revision bill that deals with the collective bargaining rights of Wisconsin in the United States is to limit the extent to which public-sector unions may engage in collective bargaining on wages, pensions and medical treatment. The failure of trade unions in the game against this act is mainly due to the fact that the wage and welfare benefits of the public sector employees, originally determined through collective bargaining, do appear to be unbalanced from those of other departments. From the legislative game in Wisconsin, three enlightenments can be drawn: the level of wages and benefits in the public sector should be determined according to the principle of balance; the level of wages and benefits of public officials in our country should not be promoted in a short period of time; "Is to determine the standard of wages and benefits of public sector employees in our country, the most effective way to reduce social disputes.
