作为土地资源的所有者和土地制度的提供者,政府对房地产土地一级市场的管控,对于促进房地产行业健康发展至关重要。本文对房地产开发用地的政府管控机制进行了全面系统的研究,着重分析了我国政府管控制度的外部制度环境,以及由此决定的政府职能和行为目标。本文将政府管控土地一级市场的原因分为市场失灵和政府失灵,将政府管控机制分为宏观调控和微观规制两个方面、中央政府和地方政府两个层次进行详细论证,得出了政府管控的综合机制,对于综合运用法律、行政和经济手段完善我国土地一级市场相关制度具有较大的借鉴意义。
As the owner of land resources and the provider of land system, the government’s control over the primary market of real estate land is very important to promote the healthy development of the real estate industry. This article has carried on the overall system research to the government control mechanism of the real estate development land, emphatically has analyzed the external system environment of the government control system in our country, and the government function and the behavior goal determined thereby. This paper divides the reasons why the government controls the primary land market into the market failure and the government failure. It divides the government control mechanism into two aspects: the macro-control and the micro regulation. The central government and the local government conduct detailed argumentation at two levels, The comprehensive mechanism has a great reference for the improvement of the relevant systems of the primary land market in China by comprehensively using the legal, administrative and economic measures.
