小产权房占用的是集体土地,按照我国现行法律,这类土地只能用于农业生产或者作为农民的宅基地,土地使用权不得出让、转让或者出租用于非农业建设,没有国家的土地使用证和预售许可证。但是,小产权房的热销,是市场一体化趋势的反映。应当区别不同小产权房进行综合整治。一是对于出现在一些城市近郊,把本该建平房的宅基地盖成楼房出售的所谓小产权房,以及农民在原旧村落的基础上建起的成片开发的小产权房,国家可以考虑承认其合法的市场主体资格身份。二要制定完善相关立法,规范小产权房的再建与交易。
