本文通过分析“红罐之争”案例的一审判决及其相关评论,从法理学的视角分别对包装装潢权与商标权加以概念辨析,对包装装潢权与商标权的关系进行了论证。包装装潢权与商标权既有联系,又有区别,文章基于人性与关系的角度深层次地分析包装装潢权与商标权的真正含义,从主观、客观以及语言要素对包装装潢权与商标权的概念进行辨析。文中对现有的知识产权法律制度的完善与进步提出了相应的建议,并对“红罐之争”案表达了相关见解。 By analyzing the judgment of the first instance and its related comments in the case of Red Box Conflict and the related comments, this article separately analyzes the concept of packaging and decorating right and trademark right from the perspective of jurisprudence, and expounds the relationship between packaging decorating right and trademark right.
