刑法中存在着大量法条规定极为简单,而内涵却非常丰富的概念,加之相似罪名的区分往往细微复杂,在刑法课程教学中急需切实可行的操作方法来解决这方面的难题。类型化方法引入直观化的形象,向生活经验开放,能克服概念的封闭性,让我们在掌握法律规范意义的情况下,结合常理等经验对案件做出合理化定性。本文首先阐释将类型化方法应用到刑法教学中的必要性,进而论述类型化方法的本质,然后结合案例,论述在刑法教学中应用类型化方法的操作进路。
There are a large number of criminal law provisions of the law is extremely simple, but very rich in connotation of the concept, combined with similarities often distinguish the subtle and complex criminal law teaching in urgent need of practical methods to solve this problem. The introduction of a typed approach into a visualized image opens up to life experience and overcomes the closedness of concepts, allowing us to rationally rationalize cases in the light of the normative significance of law and in combination with common sense and other experiences. This article first explains the necessity of applying the typological method to the teaching of criminal law, then discusses the essence of the typological method, and then discusses the operation of applying the typological method in the teaching of criminal law.
