2012年修改后的新民诉法赋予了检察机关对人民法院执行活动的监督,这一重大修订是对近十几年来理论界与实务界对民事执行检察监督探索和实践经验的肯定与吸收,使对民事执行检察监督正当性与必要性的争论尘埃落定,使检察机关对民事执行活动实施法律监督得到制度上的保障。但扔存在规定过于原则性,缺乏可操作性等制度不完善的缺陷,迫切需要构建一套特殊的程序以保障监督活动的有效性和合理性。
The new Civil Procedure Law revised in 2012 gives the procuratorial organs supervision over the execution activities of the people’s courts. This major revision affirms and absorbs the exploration and practical experience in procuratorial supervision over the past decade in both the theoretical and practical sectors The dispute over the validity and necessity of procuratorial supervision over the civil affairs has been settled and the procuratorial organs have been given institutional guarantees for the implementation of legal supervision of civil enforcement activities. However, there is a flaw in the system of overly principle and lack of operability. There is an urgent need to construct a special set of procedures to safeguard the effectiveness and rationality of oversight activities.
