中国社会权可诉性的行政法之路

尽管社会权是否具有可诉性依然存在争议,但不管是国际还是国内都大刀阔斧地开拓各种路径对社会权进行保护。我国学界对社会权的研究绝大部分停留在对社会权是否可诉的宏观层面,而社会权可诉性技术性问题远没有提上议程。在中国,宪法实施面临重重困境,而短期内建立类似西方的违宪审查制度不现实,所以转化视角寻求社会权可诉性的其他路径是中国语境下的理智选择。中国社会权可诉性的行政法路径,是通过行政法实施宪法,通过行政诉讼推动宪法诉讼,发挥行政法当前保护社会权的重要作用,最终推动社会权的宪法保障。 Despite the controversy over the feasibility of social rights, no matter whether international or domestic efforts are made to open up various avenues to protect social rights. Most scholars in our country study the social rights to stay in the macroscopic level of whether social rights can be prosecuted, and the technical problems of the suability of social rights are far from being put on the agenda. In China, the constitutional implementation faces many difficulties, and in the short term, it is unrealistic to establish a constitutional censorship system similar to the West. Therefore, other ways to seek the suability of social rights from the transformational perspective are the rational choices in the Chinese context. The administrative law path of China’s social right to sue is to implement the constitution through administrative law and to promote constitutional lawsuit through administrative litigation so as to give play to the important role of administrative law in protecting social rights and finally promote the constitutional guarantee of social rights.
