劳务派遣作为一种新的用工形式,其优点是可以节约成本、人事管理便捷、避免人才流失,可转移企业的风险。存在的问题是就业稳定性差、非法派遣问题突出、派遣劳动者与正职劳动者待遇不公平、雇主责任不明、劳动者权益缺乏保护。我国的劳务派遣法律构建要从各方面进行明确、准确地界定。
As a new form of employment, labor dispatch has the advantages of cost saving, convenient personnel management, avoidance of brain drain and risk transfer of enterprises. The existing problems are poor stability of employment, outstanding dispatch of illegal workers, unfair treatment of sending workers and full-time workers, unclear responsibilities of employers and lack of protection for the rights and interests of laborers. The legal construction of labor dispatch in our country should be defined clearly and accurately from all aspects.
