第二次世界大战后国际人权的发展总是伴随着主权国家、国际组织与特定政治行为间的复杂关系。人权的保障与实践也会对国家的权威构成挑战。随着国际人权公约在普世化、制度化与内国化上的扩展与深化,更需要重新检视国家权威所依赖的主权正当性与国际规范所建构的多边正当性,以及前两者磨合对主权国家遵从国际人权法的影响。本文以和平权为实例,探讨主权国家与国际多边权威的正当性之间冲突对人权公约实践所造成之影响。和平权等权利的实践状况,也取决于多边人权机制及主权国家对正当性问题之妥善处理。
The development of international human rights after World War II always accompanies the complicated relations between sovereign states, international organizations and specific political behaviors. The guarantee and practice of human rights will also pose challenges to the authority of the country. With the expansion and deepening of universal conventions on international human rights in the process of universalization, institutionalization and nationalization, it is necessary to reexamine the legitimacy of sovereignty on which the state authority relies and the multilateral legitimacy established by international norms, National compliance with the impact of international human rights law. This article takes the right of peace as an example to discuss the impact of the conflict between sovereign countries and the legitimacy of international multilateral authorities on the practice of human rights conventions. The practice of the right to peace and other rights also depends on the proper handling of the legitimacy issues by multilateral human rights mechanisms and sovereign states.
