近日,笔者拜读了耿春翔、姜辉、王超的《一起土地抵押权争夺战:确权后的启示》(详见《中国农村金融》2011年第3期第76页至77页)一文,其文中所述的争议来源于“一物三抵押”的法律纠纷,其中以兰山支行和B支行之间的抵押权争夺战为焦点。兰山支行通过多方查找“土地证”上存在的瑕疵,使得法院最后裁定B支行房产抵押有效、土地抵押无效;兰山支行土地抵押有效,并将该公司抵押给兰山支行的土地使用权裁定抵顶
